Our companies, la Compagnie Française des Loueurs de Ski, la Compagnie Internationale des Loueurs de Ski and American Skirental Company, Inc., respectively referred to as CFLS, CILS ASC hereinafter provide Internet winter sport equipment hire to be collected at Skiset supporting dealers (the "Dealers").

CFLS provides rental services exclusively to customers residing and skiing in France.

ASC provides rental services exclusively to customers skiing in the U.S.A and Canada.

By using our website and/or booking rental winter sport equipment through our website or telephone you agree to these General Terms and Conditions. The General Terms and Conditions may be subject to modifications. Your continued use of our website means you accept those modifications.

The content of this website may contain typographical errors or other errors or inaccuracies and may not be complete. We reserve the right to correct any errors, inaccuracies or omissions and to change and update this content at any time without prior notice. We do not, however, guarantee that any errors, inaccuracies or omissions will be corrected.

We reserve the right, without prior notification to change any descriptions or images of, or reference to any product or services on our website, or to limit the order quantity on any such product or service to you. General Terms and Conditions


Article 1: Booking an equipment hire

1 - 1: Rental Equipment

All the equipment offered for rental is described on our site, with the understanding that customers are able to either book a category of equipment (standard offer) or a specific model, under conditions the client have completed all measurements information (height, weight, boots size) of the skier who booked a particular model. The model selection, must be booked at least 7 day in advance.

Not all Dealers carry the model selection, and customers are informed on the reservation page that they may choose a specific model.

Our promises for the model selection:

  • An exclusive selection of current models of skis
  • The assurance that customers will get to ski with the equipment of their choice
  • The satisfaction or upgrade guarantee: if the model selected at the time of reservation is not available when the customer arrives at the shop, we promise to upgrade the customer's selection; if an upgrade is not possible, Skiset will provide the customer with a model at least equivalent to the model selected.

1-2: Rental fees

Rental fees vary based on the category of equipment booked and the rental period, as displayed on stage 2 of our Website's "booking" section. Prices include applicable sales tax.

The prices given in currencies other than Euro and Swiss Francs are provided for information only.

Additional information about the offer for large families

For customers hiring in France and in the shops participating in this offer.
This offer applies automatically to applications including at least 5 packs broken down as follows:

  • either 1 adult (Over 17 years) and 4 children or teenagers (Under 17 years), the cheapest pack is offered (excluding administrative fees),
  • either 2 adults (Over 17 years) and 3 children or teenagers (Under 17 years), the cheapest pack is offered (excluding administrative fees).

The discount is applied when booking, step 2.

Additional information about the offer for groups.

This offer may be accessed from the home page via a dedicated group offer menu. This offer is designed for constituted groups of at least 20 people.

For customers hiring in France
10% discount on the individual price (excluding promotional code and partner offers) and one pack free for 20 paying packs (on the basis of the cheapest pack, excluding administrative fees). The discount and free offer are applied when booking, step 2.

Clarification about the Skifit offer – 1 day to discover Skifit

This introductory offer enables the customer to try Skifit bootliners during his or her first day of hire. After this trial day, the customer may:

  • either keep the Skifit bootliners, meaning that he or she must pay for the bootliners (€79 recommended retail price) at the shop on the day of the return of the hire equipment, as shown on the voucher,
  • or return the Skifit bootliners to the Skiset shop at the most 24 hours after collecting the hired equipment.

Each Skiset shop is able to choose whether to opt for the Skifit offer or not. Customers are informed on the booking page whether it is possible to book the Skifit bootliners or not.

Clarification about the 7th day free

The offer applies for all stays of 6 days and over and entitles you to a full day of equipment hire on request in store.
The 7th free day should be requested when collecting the equipment. Any request made after collection will result in the offer becoming void.
The offer concerns the same equipment as that rented on www.skiset.com which appears on the exchange voucher.
In the event of opting for a breakage/theft guarantee when booking the equipment on www.skiset.com, it applies to the 7th free day.


1-3: Payment method

1-3-1: For customers residing outside of France and skiing in France (i), customers residing outside of France and skiing outside of France (ii), and customers residing in France but skiing outside of France (iii):

Customers renting the equipment from CILS or ASC must pay CILS or ASC.

The customer can pay CILSor ASC by credit card or via PayPal or Adyen as indicated in paragraphs A: to B: below:


A: Secure payment by credit/debit card

CILS has entered into a service agreement with Banque Cantonale Vaudoise B.C.V. and Telekurs, for electronic business ; this agreement is called «Saferpay». ASC has entered into a similar agreement with Bank of the West called Evalon Merchant Services.

These agreements aims at ensuring all necessary features to manage a merchant service and to securely acquire payments over the Internet.

Saferpay and Evalon Merchant Services handles trade security and ensures secret data protection (deciphering keys) and management.

Only credit/debit cards issued within the international networks approved by GIE Cartes Bancaires are accepted.

Financial costs (bank charges in connection with the exchange rate, banking commission for payment transactions made outside the territory where the card was issued, and other banking commissions) that may be tied to payments by credit/debit card will remain the customers' responsibility.

Once validated by the customer on our Website, the order will be placed, subject to the acceptance of the central bank card network. In the event of a refusal from the central bank card network, we will cancel the order.

When making payment, customers are automatically connected to the payment processing centre's server. Data, protected by encryption, do not transit through our systems and are therefore not stored by us in anyway.


B: Secure payment through PayPal or Adyen

CILS has entered into a service agreement with PayPal and Adyen.

These agreements aims at ensuring all necessary features to manage a merchant service and to securely acquire payments over the Internet.

PayPal and Adyen Services handles trade security and ensures secret data protection (deciphering keys) and management.

Financial costs (bank charges in connection with the exchange rate, banking commission for payment transactions made outside the territory where the card was issued, and other banking commissions) that may be tied to payments by credit/debit card will remain the customers' responsibility.


1-3-2: For customers residing in France and skiing in France

Customers residing in France and skiing in France who rent equipment at CFLS must pay CFLS.

Customers may choose to pay CFLS either by credit card, bank cheque, or French "Chèque vacances" or through PayPal as indicated in paragraphs A: to D: hereafter.

In the event of payment by bank or post office cheque or "Chèque Vacances", customers will note their reservation number on the back of said cheque and will attach a proof of address.


A: Credit Card secure payment

CFLS entered into a service agreement with Banque Populaire for electronic business; this agreement is called "Service Cyberplus Paiement".

Banque Populaire handles trade security and ensures secret data protection (deciphering keys) and management.

Only cards issued endorsed by the GIE Credit Cards international network are accepted.

Acceptance by the central credit card authority completes the Customer's order. In case of refusal by the central credit card authority, we will cancel the order. When making the payment, the customer is automatically connected to the payment centre server. Bank data are protected by encryption and do not pass through CFLS systems and are therefore not kept by CFLS.


B: Bank cheque payment

CFLS accepts bank cheque payments for the hiring of equipment (payable in France only) or giro cheques for all reservations booked more than 10 days before the first day of rental.

The cheque shall be drawn up in euros, to the order of:

If the cheque is not received at least 5 days before the customer's start date, the payment for equipment rental must be made solely by bank card. If payment is not made by bank card, the reservation will be cancelled.


C: Holiday cheque Payment

CFLS accepts French holiday cheque payments (ANCV) for the hiring of equipment or giro cheques for all reservations booked more than 10 days before the first day of rental.

CFLS recommends customers to send a holiday cheque for an amount lesser than or equal to the amount of the reservation, if needed supplemented by a bank or giro cheque. If the amount of the holiday cheque is higher than the reservation, CFLS will not be able to give change to the hirer.

If the "Chèque Vacances" is not received at least 5 days before the customer's scheduled equipment pick-up, the payment for equipment rental must be made solely by bank card. If payment is not made by bank card, the reservation will be cancelled.


Secure payment through PayPal or Adyen

CFLS has entered into a service agreement with PayPal.

These agreements aims at ensuring all necessary features to manage a merchant service and to securely acquire payments over the Internet.

PayPal Services handles trade security and ensures secret data protection (deciphering keys) and management.

Financial costs (bank charges in connection with the exchange rate, banking commission for payment transactions made outside the territory where the card was issued, and other banking commissions) that may be tied to payments by credit/debit card will remain the customers' responsibility.


1-4: Final Order

An order is considered final when payment in full is received by us in accordance with the above procedures and an electronic confirmation with an attached voucher is issued to the customer. Customer is required to print and present the voucher to the applicable Skiset Dealer.


Article 2: Making available and returning the rental equipment - Rental Period

The equipment can be collected the day before the first day of the rental period after 5:00 PM and returned at the end of the last day of the rental period or on the following morning before 10 AM. Any return of equipment made after 10 AM on the following day of the planned return date on the voucher will entail the billing by the Dealer of one day of rental at the prices shown in store.

For reservations made less than 48 hours in advance shops will do their utmost to ensure that equipment is ready, but this cannot be guaranteed in all cases.

Important:
Ages 14 - 17 Years Valid identification or proof of age will be required for all rentals.

The rented winter sport equipment become the full responsibility of the customers as soon as collected by them. The customer shall ensure its conservation and shall make use of it with due care at all times. Taking possession of the rented equipments remains the responsibility of the customer.

In case of late collection of the rented equipments, the customer shall inform the relevant Dealer as soon as possible. We ask the Dealer to keep the booked equipment at the customer's disposal for 24 hours. Passed this time, the equipments shall be made available for renting again, without compensation to the customer.

The rented equipments shall be returned to the Skiset Dealer where they were collected. Failure to return the rented equipment - regardless of the reason - will result in the Dealer billing the customer for the full value of the equipment at its public price as new, in addition -to the cost of the rental.


Article 3: Use of the hired equipment

The rental equipment is for the customer's personal use only. No possibility of subletting or lending even gratuitous use by other is permitted.

The customers are the sole judge of their ability to use the rented equipment. The customer attests to be able to use the rented equipment and pledges to use it cautiously, at no risk for third parties in accordance to the regulations in force.

All rental equipment is in good condition and shall be returned as such. The equipment being numbered or marked shall be returned with the same numbers and the same mark. Any damage - regardless of the cause - will require direct payment to the Dealer for the repair or replacement cost of up to the rental price of new equipment , in addition to the cost of hire.


Article 4: Availability of the equipment for rent

CFLS, CILS and/or ASC shall not be held liable for delays in the availability of the rented equipment - delays due to circumstances beyond their control - notably in case of an accident ; delays in the return of previously rented equipments ; modification of regulation; force majeure, strikes, etc.

In such circumstances, CFLS, CILS, and/or ASC will do their best to make available to the customer an equipment of equal or higher quality according to availability at the Dealer.


Skiset Express

SKISET Express is a service for quick collection of equipment rented on the website.

The option is offered in a selection of shops and the customer can choose this offer by ticking off the corresponding box before validating his basket. He agrees to provide all the information required to prepare the rented equipment, i.e.: the heights, shoes sizes, weights and head circumferences of all the persons included in the file. Without this information within the given deadline the option is automatically cancelled.


Article 5: Ski-Equipment Damage and Theft Guarantee (except ASC' clients)

When making the reservation, the customer can insure the rental equipment against damage (total or partial damage to the ski equipment) and theft (total or partial). The cost of this guarantee depends on the category of the equipment reserved by the customer and the rental period chosen, in accordance with the rates given below:

The ski equipment is not insured against being forgotten, lost, or exchanged at any time during the period of the rental.

Customer's obligations in case of loss::

  • In case the ski equipment is stolen, the customer will forward a receipt of the theft report made to the relevant authorities (the police, for example) to the shop where the equipment was hired.
  • In the event of damage to the ski equipment, the customer will bring the damaged equipment back to the shop where it was hired.

Article 6: Cancellation Policy

The customer has 14- days from the booking confirmation to cancel the reservation. If this period were to end on a Saturday, Sunday or on a bank or public holiday, it shall be extended to the next working day.

This cancellation right does not apply where the reservation is booked 14 days or less from to the scheduled pick-up.


6-1: Exercising the withdrawal right

In case of exercise of the withdrawal right within the 14-day cancellation period, the sums paid by the customer shall be refunded less an administrative charge of 1€ per person including taxes (except ASC' clients). The refund is made whether by crediting the card used for the transaction ; or by bank cheque if the customer paid by bank cheque or holiday cheque ; or by crediting the PayPal or Adyen account used for the transaction.


6-2: Cancellation before collecting the equipment and after the 7-day cancellation period during the following periods

  • All cancellation of hire until 5 days (included) before the beginning of the hire will result in the refund of the rental and the Ski Equipment Damage and theft guarantee if taken previously, less a 3% cancellation fee.
  • All cancellation of hire between 4 and 3 days (included) before the beginning of the hire will result in the refund of the rental and the Ski Equipment Damage and theft guarantee if taken previously, less a 50% cancellation fee.
  • Passed 3 days before the beginning of the hire, no cancellation shall be authorized and no refund shall be claimed.

Except for school holidays:

  • All cancellation of hire until 3 days (included) before the beginning of the hire will result in the refund of the rental and the Ski Equipment Damage and theft guarantee if taken previously, less a 3% cancellation fee.
  • All cancellation of hire until 2 days before the beginning of the hire will result in the refund of the rental and the Ski Equipment Damage and theft guarantee if taken previously, less a 50% cancellation fee.
  • Passed 2 days before the beginning of the hire, no cancellation shall be authorized and no refund shall be claimed.

6-3: Cancellation after collecting the equipment

In case of illness or accident occurring during the rental period, the rental conditions remain applicable. The equipment rented by the effected customer only may be returned and billed in pro rata for the number of days of rental actually spent (upon presentation of a medical certificate and a notification of the store for having returned the equipment).

In this case, the refund (less an administrative charge of 1 € per person including taxes (except ASC' clients). will be made whether by crediting the card used for the transaction; or by bank cheque if the hirer paid by bank or holiday cheque ; or by crediting the PayPal or Adyen account used for the transaction. Partial days will not be refunded.


6-4: Cancellation due to weather conditions

In case of full closure of the ski area normally accessible from the place of equipment rental and due to bad weather conditions only, the involved days of rental will be refunded upon presentation of a supporting document issued by the resort's ski lift company.


Article 7: Trademarks

We own the service mark "Skiset" which is protected by national and international trademark laws. The other trademarks of ski equipment manufacturers used on our website are the trademark of their respective owners.


Article 8: Disclaimers

We provide this website, the site materials, and any product or service obtained through or in connection with this website on an "as is" and "as available" basis without representations or warranties of any kind, either express or implied, unless otherwise expressly provided in a written, agreement with us to which you are a party with regard to a particular product or service.

To the fullest extent permissible pursuant to applicable law, we and our affiliates, licensees, suppliers, advertisers, and agents disclaim all warranties, express or implied, including, but not limited to, implied warranties of title, merchantability, fitness for a particular purpose, and noninfringement, unless otherwise expressly provided in a written agreement with us to which you are a party with regard to a particular product or service, we and our affiliates, licensees, suppliers, and agents do not warrant that your use of this website or the site materials will be uninterrupted, error-free, or secure, that defects will be corrected, or that this website (or the server(s) on which it is hosted) or related software are free of viruses or other harmful components..

No opinion, advice, or statement of us or our affiliates, licensees, suppliers, agents, or visitors, whether made on this website, in the site materials, or otherwise, shall create any warranty, unless otherwise expressly provided in a written agreement with us to which you are a party with regard to a particular product or service. Your use of this website is entirely at your own risk.


Article 9: Limitation of Liability

CFLS, CILS and/or asc shall not be liable to customers for any indirect, incidental, special, consequential or punitive damages howsoever arising and CFLS, CILS and/or asc's liability to customers shall not exceed the amount paid by customers for the services in question.


Article 10: Indemnification

Without limiting the generality or effects of other provisions of these General Terms and Conditions, you agree to indemnify, hold harmless and defend us, or our affiliates, licensee, suppliers and agents, and each of their officers, directors and employees, from and against any and all claims, damages, losses, costs (including reasonable attorneys' fees), or other expenses that arise directly or indirectly out of or from (a) your breach or alleged breach of these General Terms and Condition or (b) your use of our website and engagement in transactions on this website.


Article 11: Void where prohibited

Although our website is accessible worldwide, not all products or services discussed or referenced or our website are available to all persons in all geographic locations or jurisdictions.

In addition, restrictions may apply to use of products or services obtained in one jurisdiction to other jurisdictions. Those who choose to access this website do so at their own risk and are responsible for compliance with their local laws if and to such extent those laws are applicable.

We and our affiliates, licensee, suppliers and agents, reserve the right to limit the availability of this website and/or the provision of any product or service to any person, geographic area and or jurisdiction we and they so desire, at any time and in our or their sole discretion.


Article 12: Personal Data

The customer must refer to the section "Legal statements - personal data" of this site.


Article 13: Applicable Jurisdiction

In case of a dispute arising out of or relating to this agreement, and failure to an out-of-court settlement, the dispute shall be resolve by the competent Court according to the applicable procedure rules:

For all rental made by CFLS, French Law shall be the sole applicable to any dispute of any kind whatsoever and the French Courts shall be of exclusive jurisdiction.
For all rental made by CILS the Swiss Law shall be the sole applicable to any dispute of any kind whatsoever and the competent Courts for the ski resort where the equipment was hired from shall be of exclusive jurisdiction.
For all rental made by ASC, the Law of the State of Colorado shall be the sole applicable to any dispute of any kind whatsoever and the competent courts of that State shall be of exclusive jurisdiction.
