Cancellation

ARTICLE 1 – NATURE OF THE COVER

L'Européenne d'Assurances Voyages reimburses you for the cancellation penalty levied by the ski equipment hire company in application of its GeneralTerms and Conditions of Sale up to the maximum limit on the scale in yourspecific terms and conditions, if the cancellation has been notified before departure, and occurs after the insurance has been taken out as a result of one of the following events:

Death, serious accidental bodily injury, serious illness including deterioration of a chronic or pre-existing illness subject to the condition not having been medically diagnosed in the month prior to the date on which the holiday was booked, of the following persons: the insured person, his/herspouse or common law partner, his/her ascendant or descendant (up to the 2nd degree), father-in-law, mother-in-law, brother, sister, brother-in-law,sister-in-law, son-in-law, daughter-in-law, or any person who usually lives with the insured person.

Serious illness is understood to be any alteration to a person's health, diagnosed by a certified competent medical authority, and which requires the person to cease all professional or other activity and requiring appropriate treatment.

A serious accidental bodily injury is understood to be any bodily injury not intentionally caused by the victim, and arising from the sudden action of an external cause that has been diagnosed by a certified competent medical authority, and which requires the person to cease all professional or other activity and prevents him/her from moving about unaided.

Redundancy of the insured person or his/her spouse or common law partner who is insured under this same policy, provided that the procedure had not been started by the day on which this policy was taken out.

Cancellation by a person who was planned to accompany the insured person (max. four persons) on the holiday and who booked at the same time as the insured person, and who is insured under this same policy, when the cancellation occurs as a result of one of the reasons listed above.

For a covered event, if the insured person prefers that the place should be taken up by another person, instead of cancelling the trip, we will pay the costs to change the name that are levied by the supplier.

In all cases, the amount of this compensation may not be more than the amount of cancellation fees chargeable at the date of the claim event.


ARTICLE 2 – EFFECTIVE PERIOD OF THE COVER

Subject to the insured having previously paid the corresponding premium and having taken out this policy on the day of the holiday booking, or at the latest on the day before penalties commence according to the cancellation penalties scale, cover takes effect from the date when this policy is taken out and expires at the time of departure, or when the keys are handed back in the case of rental accommodation.

NOTE:

  • If the insured person is late in making the cancellation, L'Européenne d'Assurances Voyages shall only be responsible for the cancellation fees chargeable at the date on which the claim generating event occurred.
  • If you take out cover after the reason for the trip cancellation occurred and you knew about it, the cancellation will not give rise to compensation.

ARTICLE 3 – COVER LIMITS

Compensation due by virtue of this cover can not exceed the actual amount of penalties charged up to the maximum limit shown in the table in the specific terms and conditions for cancellation of the ski equipment hire.

Under no circumstances, can compensation exceed the amounts stated in the Table of Cover.

Administration fees, the insurance premium, airport taxes and visa costs are not refundable.


ARTICLE 4 — EXCESS AMOUNT

In all cases, L'Européenne d'Assurances Voyages will pay compensation to the insured person after deduction of the excess amount as shown in the Table of Cover.


ARTICLE 5 - EXCLUSIONS

Any event that is not specified in Article 1 "Nature of the cover" is excluded. In addition to the exclusions contained in the General Terms and Conditions, cancellation arising from the following is not covered:

Infectious risk situations during an epidemic requiring a quarantine period or specific preventive or monitoring measures by the local and/or national health authorities;

Atypical pneumonia or Severe Acute Respiratory Syndrome (SARS), bird fluor flu of type A-H1NI, and any pandemic or epidemic recognised by the national or international health authorities;

The death of a relation, if this occurs over one month prior to the departure date,

An illness or accident resulting in the start, a relapse or deterioration or hospitalisation in the month prior to the travel booking,

Beauty treatment, spa treatment, voluntary termination of pregnancy, in vitro fertilisation and its consequences, artificial insemination and its consequences, pregnancy,

Making a late visa application to the competent authorities, passport irregularity, failure to get vaccinated,

A psychological or mental illness or depression not requiring hospitalisation or resulting in a hospital stay of less than 3 days.


ARTICLE 6 - OBLIGATIONS IN THE EVENT OF A CLAIM

The insured person or his/her beneficiaries must:

When the claim event occurs, notify the company from which the insured person purchased the services.
If the insured person is late in making the cancellation L'Européenne d'Assurances Voyages can only be responsible for the cancellation fees chargeable at the date on which the event occurred.

Notify L'Européenne d'Assurances Voyages, in writing when the claim event occurs, and, at the latest within 5 working days.

After this time period, the insured person will forfeit all entitlement to compensation if his/her delay has caused harm to L'Européenne d'Assurances Voyages.

Send L'Européenne d'Assurances Voyages all the documents that were quire to set up the file, prove the claim's validity and the amount of the claim, and in particular the insured person's pay-slip for the departure month.

In all cases, the insured person will always be asked to supply originals of the cancellation charges and booking invoices.

Unless you provide our medical adviser with the medical information required for investigation of the claim, the case file will not be paid out.


REPATRIATION - ASSISTANCE

ARTICLE 1 - THE INSURED PERSON IS ILL OR SUFFERS A BODILY ACCIDENT

The medical team of L'Européenne d'Assistance will contact the local attending medical practitioner and/or family doctor, in order to take the most appropriate steps in connection with the insured person's condition.

The medical team of L'Européenne d'Assistance arranges for the insured person to be transported to the nearest medical centre to his/her home or to be transferred to a better equipped or specialist hospital.

Depending on the seriousness of the insured person's condition, only the medical authorities of L'Européenne d'Assistance are authorised to make the decision on repatriation and to select the means of transport and the hospital location. Reservations are made by L'Européenne d'Assistance.

L'Européenne d'Assistance will repatriate the insured person to his/her home if his/her condition is such that they are able to leave the hospital.

If the condition of the insured person justifies it, L'Européenne d'Assistance organises and pays the travel costs for a person who is at the holiday location to accompany the insured person.

If the insured person's condition does not justify hospitalisation or repatriation and the insured person is unable to return on the originally scheduled date L'Européenne d'Assistance pays for the actual expenses of extending the stay in the hotel and the expenses of the person who stayed to visit them in hospital, up to the maximum amount stated in the Table of Cover,(receipts to be provided), but excluding the cost of meals.

L'Européenne d'Assistance pays the cost for the insured person and their hospital visitor to return when the insured person's condition permits.

If the insured person is in hospital and their state of health does not require it, or it prevents immediate repatriation or return, L'Européenne d'Assistance organises hotel accommodation for the person designated by the insured person, who is already at the location and visiting them in hospital and pays any unforeseen costs actually incurred (excluding meals) up to the maximum amount shown in the Table of Cover, (receipts to be provided), until the insured person is repatriated.

L'Européenne d'Assistance pays for this person's return travel, if they are unable to use the originally planned means of transport.

If the hospital stay exceeds 7 days, and if nobody is staying to visit the insured person in hospital, L'Européenne d'Assistance provides a roundtrip ticket or the person designated by the insured person to get to them (only applicable to a departure from a Member State within the European Union or Switzerland) and arranges hotel accommodation for that person (maximum: see Table of Cover).

When the insured person's state of health allows, L'Européenne d'Assistance arranges and pays for their return and for the return of the person who stayed with them, when applicable.

If the insured person's state of health is such that they are unable to look after their minor children and no other adult member of the insured person's family was travelling with them, L'Européenne d'Assistance arranges travel for the person designated by the insured person to accompany them when returning to the insured person's home.


ARTICLE 2 – IN THE EVENT OF DEATH

L'Européenne d'Assistance arranges and pays the cost of transporting the body from the place where it is placed in the coffin to the place of burial in a member state of the European Union or in Switzerland.

Funeral costs are covered up to the amount shown in the Table of Cover

L'Européenne d'Assistance, when applicable, arranges and pays the cost of return travel for members of the family to the burial place if they were participating in the same trip and are covered under this same policy.


ARTICLE 3 – OTHER ASSISTANCES TO PERSONS

Early return:

L'Européenne d'Assistance arranges and pays for the insured person to return home, if he/she is obliged to curtail the trip because of:

  • The death of a member of the family, the death of the person specified in your Specific Terms and Conditions as your professional replacement or the person responsible for the care of your minor or disabled children.
  • The hospitalisation or bodily accident or serious illness of your spouseor common-law partner, or your ascendants or descendants of the first degree of a life-threatening nature, as communicated in a medical report sent by the attending doctor to the l'Européenne d'Assistance Assistance Department.
  • The occurrence of serious damage, from fire, explosion, theft, or caused by natural forces in your private or business premises and making your presenceat the location essential.

If the time frame permits and the insured person's presence is necessary to continue the trip, L'Européenne d'Assistance arranges and pays for the insured person to return to the holiday location.


Repatriation and transportation of the other insured persons:

If, as a result of the insured person's repatriation, the other covered persons travelling with the insured person and named on the insurance certificate are no longer able to return home by the originally planned means, L'Européenne d'Assistance arranges and pays for their return travel(maximum of 4 persons).


Medical costs:

L'Européenne d'Assistance refunds the insured person, after payment by Social Security and any other provident organisation, for the medically prescribed medical, pharmaceutical, surgical and/or hospital costs, incurred outside of the insured person's country of residence up to the amounts shown inthe Table of Cover, with deduction of the stated excess.

In addition, if the insured person is outside their country of residence, and is unable to pay the medical expenses arising from hospitalisation as a result of an illness or accident that occurred during the covered period shown in the policy application form, L'Européenne d'Assistance may, if requested to do so by the insured person, make an advance, up to the commitment limits of L'Européenne d'Assistance, in exchange for a security deposit cheque for the amount that corresponds with the estimated amount of costs. You will be asked to provide an acknowledgement of the debt at the holiday location.

The security deposit cheque will only be returned after proof has been received of the official position from Social Security and/or any other provident organisation responsible for paying the costs that have been advanced. This cover ceases from the day on which L'Européenne d'Assistance is able to repatriate the insured person, or the day on which the insured person returns to their country of origin.


Illness or accident suffered by a minor or disabled child of the insured person who stayed in the home country:

While the insured person is away, if one of their minor or disabled children who stayed in the home country is ill or has an accident, L'Européenne d'Assistance is available to assist the person responsible for the child'scare to arrange for the child to be transported to the hospital which is the most suitable to provide the care required by their state of health, subject to the insured person giving their prior written authorisation.

L'Européenne d'Assistance arranges for the insured person's child to return home and will keep the insured person informed of their condition, if the insured person has provided an address during the trip. If the presence ofthe insured person is essential, L'Européenne d'Assistance organises for them to return.


Despatch of medicines:

L'Européenne d'Assistance undertakes to take all steps to search for and despatch medicines that are essential for on going treatment, if the insured person has run out of these medicines and is unable to obtain these medicines or their equivalent locally. The cost of such medicines is payable by the insured person. You undertake to refund us the cost of these medicines within three months of receiving them. After this time, L'Européenne d'Assistance will be entitled to claim expenses and legal interest at the statutory rate in addition.


Communication of important, urgent messages:

L'Européenne d'Assistance undertakes to communicate messages to the insured person, if he/she cannot be contacted directly.

Likewise, L'Européenne d'Assistance, if requested to do so by the insured person, can communicate a message left by the insured person, to a member of the family. Messages are communicated solely under the responsibility of the message author who must be identified.


Emergency costs including search and rescue costs

L'Européenne d'Assurances Voyages will pay emergency, search and rescue costs up to the per event amount shown in the Table of Cover for operations organised by the civil or military rescue services or by any other specialist public or private organisations called upon in the event of the disappearance or bodily accident suffered by the insured person.


ARTICLE 4 - LIMITATIONS TO COMMITMENTS

The actions that L'Européenne d'Assistance may be called upon to carry out are performed in full compliance with national and international laws and regulations. Our intervention services are subject to obtaining the necessary approval from the competent authorities.

L'Européenne d'Assistance cannot be held liable for delays or hindrance to the performance of the agreed services as a result of strikes, riots, popular movements, restrictions on free circulation, sabotage,terrorism, civil or foreign wars, the effects of radiation or any other exceptional circumstances or a case of force majeure.

Services which have not been requested during the trip or which have not been organised by L'Européenne d'Assistance do not provide entitlement to any compensation payment.

L'Européenne d'Assistance determines the type of ticket that the insured person will be provided with, depending firstly on the options offered by carriers, and secondly by the length of the journey.

If the insured person is domiciled in a country other than a member country of the European Union or Switzerland, L'Européenne d'Assistance may, at the insured person's request, repatriate him/her to their home or to the nearest hospital, or the best equipped hospital or a specialist hospital. In this case, the insured person undertakes to pay L'Européenne d'Assistance the additional cost of this repatriation as compared to repatriation under the same conditions to Metropolitan France.

Cover takes effect on the day of departure and shall not exceed 90 days.The limit of the commitment of L'Européenne d'Assistance is stated in the Table of Cover.

An event is understood to be: any act that generates damaging consequences,that is liable to result in the operation of one or more types of cover underthis policy.


ARTICLE 5 – COVER EXCLUSIONS

Any event that is not specified in Article 1 "Nature of the cover" isexcluded. In addition to the General Exclusions, cover provided byL'Européenne d'Assistance does not apply in the following cases:

  • Infectious risk situations during an epidemic requiring a quarantineperiod or specific preventive or monitoring measures by the local and/or national health authorities;
  • Atypical pneumonia or Severe Acute Respiratory Syndrome (SARS), bird fluor flu of type A-H1NI, and any pandemic or epidemic recognised by the nationalor international health authorities.
  • When the damage or accidents result from the use of a two-wheeledmotorised terrestrial vehicle, a jet ski or snow scooter;
  • Damage constituting environmental damage suffered by natural elements such as air, water, earth, fauna, flora, which are used in common by all, as well as damage of an aesthetic or pleasurable nature attached to these elements.
  • Damage caused by the abnormal intensity of a natural agent
  • Pollution, natural disasters,
  • Pre-existing convalescence, ailments and illnesses or those undergoing treatment.
  • The consequences of serious bodily accidents that occurred before the date on which the insured person's became effective
  • Psychological or mental illness or depression
  • Ailments or minor injuries which can be treated on the spot and which donot prevent the insured person from continuing the journey or trip,
  • Dental treatment
  • Travel undertaken for the purpose of diagnosis and/or treatment,
  • Costs incurred after your return from the trip or after expiry of cover,
  • Expenses incurred without the prior approval of l'Européenne d'Assistance,
  • Telephone costs except for calls made to our Assistance Call Centre.
  • Costs of taxis incurred without our approval;
  • Consequences of pregnancy: childbirth, Caesarean, neonatal care, termination of pregnancy;
  • Expenses incurred without the prior approval of our Assistance department;
  • Pre-existing illnesses or injuries, diagnosed and/or treated, which required a stay in hospital in the 6 months prior to the trip;
  • The cost of treatment or care not resulting from a medical emergency.
  • The cost of treatment or care, the therapeutic nature of which is not recognised by French legislation.

SNOW COVER

In the event of a cancellation as a result of the partial or total closureof the ski area, L'Européenne d'Assurances Voyages will refund the insuredperson with the advance payment or deposits held by the hire company byapplication of the terms and conditions of the contract for the hire of skiequipment.

This cover is only available for:

  • Ski resorts located at an altitude over 1,500 metres;
  • For departures between the 3rd Saturday in December and the 2nd Saturday in April, the official opening and closing dates of the ski areas.

A lack of snow or excess snow will be established in the winter sports resort of the holiday, if over 2/3 of the ski lifts which are normally inoperation at the location are closed for at least 2 consecutive days, in the 48 hours preceding or after the date on which the ski equipment hire starts.

This cover will only apply on the basis of a snow conditions report published by the authorised organisation for the actual ski resort if the ski resort is a member of that organisation, or if not a member, by the closest resort as the crow flies, or by the hire company.


REIMBURSMENT OF SKI PASSES

If a covered risk occurs, L'Européenne d'Assurances Voyages will make arefund the cost of unused ski passes and skiing lessons to the insured person,on a pro-rata basis and up to the limit stated in the Table of Cover, andsubject to presentation of supporting documents.


LOSS OR THEFT OF SKI PASSES

If a covered risk occurs, L'Européenne d'Assurances Voyages will make a refund the cost of unused ski passes and skiing lessons to the insured person,on a pro-rata basis and up to the limit stated in the Table of Cover, and subject to presentation of supporting documents.


GENERAL EXCLUSIONS

In any of the following cases, L'Européenne d'Assurances Voyages shallnot be liable:

  • Use of drugs or any stupefying substance mentioned in the French Public Health Code, medicines and treatments not prescribed by a doctor;
  • The consequences of traffic accidents caused by the insured person when he/she is under the influence of alcohol characterised by presence in the blood of a degree of alcohol over the legally authorised maximum in force in the country in which the accident occurred;
  • The consequences of being under the influence of alcohol, intentional acts, fraudulent faults
  • The insured person's conscious non-compliance with the laws and regulations in force in the State of the holiday location;
  • The insured person's suicide or attempted suicide, self-mutilation;
  • Participation in bets, crimes, fights (except in a case of legitimate defence);
  • Damage intentionally caused by the insured person, at his/her order or with his/her complicity or aid;
  • Manipulation or holding of weapons;
  • All cases of force majeure making it impossible for the policy contract to be performed, especially when bans are imposed by local authorities;
  • Civil or foreign wars, riots, popular movements, strikes, acts of terrorism or sabotage;
  • An accident resulting from any nuclear fuel, radioactive product or waste, any device intended to irradiate or explode by nuclear fission, as well as decontamination from it, irrespective of whether this occurs in the departure country, transit country or destination country;
  • Infectious risk situations during an epidemic requiring a quarantine period or specific preventive or monitoring measures by the local and/or national health authorities;
  • Atypical pneumonia or Severe Acute Respiratory Syndrome (SARS), bird fluor flu of type A-H1NI, and any pandemic or epidemic recognised by the nationalor international health authorities;
  • An earthquake, volcanic eruption, tidal wave, flooding or natural cataclysm except as provided for under the terms of Law N° 86-600 of 13 July 1986 relating to compensation for victims of Natural Disasters;
  • Damage constituting environmental damage suffered by natural elements such as air, water, earth, fauna, flora, which are used in common by all, as well as damage of an aesthetic or pleasurable nature attached to these elements;
  • Accidents resulting from the insured person's participation in sport inan official competition organised by a sports federation and for which alicence has been issued and training for the purpose of competitions;
  • High mountain climbing above 3,000 metres, bobsleigh, hunting wild animals, air sports, skeleton, potholing and off-piste skiing, single-handed sailing and/or sailing over 60 miles from the coast;
  • Political problems incurring a risk to personal safety;
  • Driving any vehicle if you do not have the corresponding permit, licence or certificate.

OBLIGATIONS IN THE EVENT OF A CLAIM

L'Européenne d'Assurances Voyages has delegated claims administration to Cabinet Chaubet Courtage, except for claims in connection with Repatriation Assistance.

The policyholder or insured persons must, therefore, declare any claims toCabinet Chaubet.

When help under Assistance cover is required, the insured person mustrequest our assistance:

You will then be issued with a case number, which is the only authority forus to take action.

When claiming a refund, the insured person must attach the following itemsto the claim declaration: - Their Specific Terms and Conditions, which form thecertificate of insurance.

  • The case number assigned by the Assistance Call Centre.
  • A medical certificate showing the exact nature and date on which the illness or injury occurred. Unless you provide our medical adviser with the medical information required for investigation of the claim, the case file will not be paid out.
  • The death certificate.
  • The account statements from Social Security and/or any other provident organisation.
  • And, more generally, when we request you to do so, any document requiredfor claim investigation and without delay.

Unless you provide the documents listed above, which we need for claiminvestigation, your claim will not be paid out.

DEFINITIONS

YOU, THE INSURED PERSON

Any person who has purchased a ski pass and/or hired ski equipment from a hire company and who expressly requests the benefit of the cover provided by this policy. The only persons covered are those, for the whole of their trip being a maximum of 90 days, whose ski pass or hire contract falls within the effective date of this policy and its termination date.


WE/US, THE INSURER: LA COMPAGNIE EUROPÉENNE D'ASSURANCES VOYAGES

(under the brand name of L'EUROPÉENNE D'ASSURANCES VOYAGES) which undertakes to pay the sums covered in the event of an Insurance claim and to provide the services or pay the sums covered in the event of an Assistance claim.


SERIOUS BODILY ACCIDENT

Any bodily injury, not intentionally caused by the victim and arising from the sudden and unforeseeable action of an external cause after the date on which the policy cover becomes effective and has been diagnosed by a medical doctor and which requires the victim to completely cease all business or other activity.


BENEFICIARY

Person receiving payments made, not on their own behalf,but because of their relationship with the insured person. Unless stipulated otherwise, when taking out this policy, only the spouse, otherwise the children, otherwise the heirs of the insured person are exclusively intended.


ESSENTIAL ITEMS

Items of clothing and toiletries providing you with replacements due to the temporary unavailability of your personal effects.


FORFEITURE

Loss of entitlement to be covered for the claim incident inquestion, as a result of non-compliance by the policy holder, the insured personor by the beneficiary.


DOMICILE/HOME

The insured person's usual place of residence in Metropolitan France including Corsica, the French Overseas Departments and Territories and Monaco, in Switzerland or in one of the member countries of the European Union. In the event of a dispute, the tax address is considered to bethe domicile address.


EFFECTIVE PERIOD OF COVER

Subject to payment of the corresponding premium having been made in advance, cover takes effect on the day of departure andterminates on the day of return and lasts for the period stated in your Specific Terms and Conditions, without however exceeding 90 days. However, cancellation cover takes effect on the day that the policy is taken out and expires on the day of departure or when keys are handed back for rental accommodation.


GEOGRAPHICAL EXTENT

Cover applies worldwide.


EXCESS

The sum you are liable to pay and which is always deducted from the compensation amount paid out.


MEDICAL COSTS

Medically prescribed pharmaceutical, surgical,consultant's and hospital costs required for the diagnosis and treatment of an illness.


FUNERAL COSTS

First conservation costs, handling, placing in coffin, specific arrangements for transportation, conservation made compulsory by legislation, packaging and simplest coffin required for transportation and compliance with local legislation, excluding burial, embalming and ceremony costs.


SEARCH COSTS

Cost of operations undertaken by rescuers or rescue bodies, other than your travel companions, who set out specifically to search for you in a place which does not have any organised rescue services in the vicinity.


EMERGENCY/RESCUE COSTS

Transport costs after an accident (when you have been found) from the place where the accident occurred to the nearest hospital.


SERIOUS ILLNESS

Any alteration in your health, diagnosed by a medical doctor, and which requires you to completely cease all business or other activity.


HIRE COMPANY

The Companies CILS and CFLS trading under the brand names:Skishop, Skishop-Rent, Skirental, Location de Ski 18-25.


MEMBERS OF THE FAMILY

Your spouse or common-law partner, your ascendants or descendants up to 2 degrees of relationship with you, father-in-law, mother-in-law, brother, sister, brother-in-law, sister-in-law, son-in-law, daughter-in-law.


HOW TO TAKE OUT THE POLICY

This policy must usually be taken out at the same time as you make your travel booking. However, in the period prior to the commencement of the penalty charges scale, you may be allowed to take out the insurance policy after you have made your travel booking.


VALUABLES

Jewels, items made from precious metal, precious and semi-precious stones, pearls, watches are considered to be valuables.


TIME LIMITATION

Any legal action arising from this policy is subject to a time limitation period of 2 years from the event which gives rise it (Articles L 114-1 and L 114-2 of the French Insurance Code. See section on additional provisions).


CIVIL LIABILITY

Obligation to repair the consequences of damage caused to a third party by one's act or the act of persons for whom one is responsible or the act of things which one has custody of.


CLAIM

Occurrence of a harmful event that is foreseen and covered by the policy.


SUBROGATION

In consideration for the payment of compensation and, up toits limit amount, we become beneficiaries of the rights and actions that you own against anyone liable for the claim, in accordance with the terms of Article L 121-12 of the French Insurance Code. If, by your act, subrogation cannot be exercised in our favour, we are discharged of all or part of the obligations towards you.


DEPRECIATION

Depreciation of an item's value caused by time, use or its current condition on the day of the claim incident.


THEMED HOLIDAY:

Principal reason for the insured person's purchase ofthe package holiday and the main activity during the holiday.


COMPENSATION

CALCULATION

The compensation which is due, is established by mutual agreement, failing this by jointly agreed assessment, subject to the respective rights of the parties. For the jointly agreed assessment, each party selects an expert. If the appointed experts do not agree, they appoint a third expert: the three experts work in common on a majority vote basis. Each party pays the fees and expenses of their own expert and half of the fees of the third expert, if appointed.


PAYMENT

Unless the payment is disputed, we will pay the compensation within 15 days after the agreement made between the parties or by an enforceable courtruling.


ADDITIONAL PROVISIONS

MEDIATION

We subscribe to the mediation procedures established by the professional insurance organisations, that are freely available to everyone and the purpose of which is to promote out-of-court settlement of disputes that arise between policy holders and insurers. The body that has been set up to centralise claims by policy holders is: MEDIATION ASSURANCE, BP 907 - 75424 Paris Cedex 09.


CUMULATIVE INSURANCE

Under the terms of Article L 121-4 of the French Insurance Code, if you are covered for the same risks with one or more other insurance companies, withcover that extends over the same insurance period as this policy, you must inform us of this and provide us with their details and the scope of the cover you have taken out with them. If we prove your bad faith or your fraud in taking out cumulative policies, the penalty incurred will be to render the policy void and damages will be awarded.


PENALTIES APPLICABLE IF YOU MAKE AN INTENTIONALLY FALSE STATEMENT AT THETIME OF THE CLAIM

Any fraud, non-disclosure or intentional false statement by you about the circumstances or consequences of an incident will result in the loss of all entitlement to services or compensation for this claim. You will incur this forfeiture of rights even if L'Européenne d'Assurances Voyages has not strictly suffered any harm from the act of the fraud.

LAW ON INFORMATION TECHNOLOGY AND FREEDOM

In accordance with the French Law on Information Technology and Freedom No.78-17 of 6 January 1978, you have the right to access and correct any personal information that is contained in all the files used by L'Européenne d'Assurances Voyages. You can exercise your right to access and correct personal information at the Head Office of L'Européenne d'Assurances Voyages.


SUBROGATION

In accordance with the provisions of Article L 121-12 of the French Insurance Code, L'Européenne d'Assurances Voyages becomes the beneficiary of your rights and actions in consideration for the payment of compensation and up to the amount of compensation. We, therefore, become beneficiaries of the rights and actions that you owned against anyone responsible for the claim for which we have compensated you. If, by your act, we are no longer able toper form this action, we can be discharged of all or part of our obligations towards you.


TWO-YEAR TIME LIMITATION

In accordance with Article L 114.1 of the French Insurance Code, the time limitation for any action arising from the policy can be suspended for one of the standard reasons for suspension such as: a legal summons, the appointment of an expert as the result of a claim, the despatch of a registered letter with acknowledgement of receipt by the insured person to the insurer to request payment of compensation after the claim incident, by the insurer to the insured person commencing action for the payment of the premium.


APPLICABLE LAW AND JURISDICTION

This policy is governed by French law. The contracting parties state that they submit to the French courts and tribunals
